Expungements
An expungement is a court order to remove an arrest or conviction from the public view. However, law enforcement agencies as well as some state board agencies may still be able to view it. The general public (including landlords, financial institutions, employers) will not be able to see it once the record is expunged.
There are several ways in which one’s record may be expunged:
-
You may have plead guilty pursuant to Louisiana Code of Criminal Procedure article 893 for a felony offense, or code article 894 for a misdemeanor. Pleading under those code articles allows for you to move for an expungement once you have successfully completed your probated sentence.
-
You were arrested but the case was refused or dismissed.
-
More than 10 years have passed since the completion of your sentence, or completed probation or parole for certain felony offenses. Or:
-
More than 5 years have passed since the completion of your sentence for a misdemeanor offense.
There are other factors to take into account when determining whether one may qualify for an expungement in Louisiana. Contact us today to see if you qualify! legal@attorneydjuan.com
